Terms of Use

These Terms of Use ("Terms") govern your use of Xivena. By creating an account or using the Service, you agree to these Terms and confirm that you have read our Privacy Policy. If you do not agree, do not use the Service.

Xivena is operated by Babakulov Shakhzodbek, an individual sole trader ("Xivena", "we", "us", "our"), contactable at babakulov@xivena.com.


1. Definitions

Service — the Xivena website at xivena.com and the Xivena applications for iPhone and Android, together with every feature we make available through them. You — the person who creates an account or uses the Service. Content — anything generated, displayed, or made available through the Service, including AI-generated readings and replies. Your Content — the information you provide, such as your birth details, your answers to our questionnaires, your dream journal entries, your notes, your messages to the companion, and any photographs you take within the Service. AI Output — any Content produced by our AI features in response to your inputs. Tokens — the units in which the Service measures use of its AI features. Each account has an allowance of tokens; paid plans and purchases add more.


2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you confirm that you are 18 or over, that you can enter into a binding agreement with us, and that the information you provide is accurate.


3. Your account

You sign in with Apple, Google, or an email address. You are responsible for keeping your sign-in details secure and for everything that happens under your account. Tell us promptly at babakulov@xivena.com if you believe your account has been compromised.

Creating an account is your agreement to these Terms and your acknowledgement of our Privacy Policy. The sign-up screen says so and links to both documents. When you create an account, our servers record which version of each document was in force at that moment. There is no separate box to tick.

You may close your account at any time from Settings. Section 16 explains what happens then.


4. The Service

Xivena is a personal companion for your inner life. It offers two kinds of feature, and these Terms treat them differently because they rest on different things.

4.1 Self-reflection features

Questionnaires and written reflections that draw on models from psychological research (section 6 sets out which, and what we do not claim from them):

  • Assessments covering personality, chronotype, attachment, personal values, and character strengths
  • Your Portrait — a written synthesis of the assessments you have taken
  • Your People — reflections on how you relate to the people you add
  • A dream journal with interpretations
  • Guided reflections ("Lenses")
  • Conversations with your AI companion by chat, voice, and video
  • Notes the companion keeps about you, which you can read and edit

4.2 Astrology and divinatory features

Offered for entertainment: horoscopes and zodiac insights, tarot, live transits, palm reading, compatibility reports, and small games.

Not every feature is available in every app. The iPhone app offers the self-reflection features only; the website and the Android app also offer the astrology features, and the small games are on the website only. We may add, change, or remove features at any time to improve the Service, and we will give reasonable notice of material changes where we can.

4.3 Tokens and the free allowance

Use of AI features consumes Tokens. Every new account receives a one-time free allowance. It does not renew, and it is granted once per person: if you delete your account and later create another one with the same email address, the new account does not receive a second free allowance. Section 2.15 of our Privacy Policy explains how we recognise a returning account and what we keep in order to do so. Paid plans and purchases work normally on any account.


5. AI-generated content and disclaimer

Xivena uses artificial intelligence to generate your Portrait, your companion's replies, dream interpretations, horoscopes, tarot, palm analysis, and other readings. This Content is created automatically and may be inaccurate, incomplete, or inconsistent. Review it before relying on it.

Nothing on Xivena is professional medical, psychological, financial, or legal advice, and no result we give you is a diagnosis. We make no promise about any outcome. Do not make important life decisions based solely on Content from the Service. Always consult a qualified professional.

  • Self-reflection features — assessments, your Portrait, Your People, the dream journal, Lenses, and your companion — are provided for self-reflection and general informational purposes only. They are not clinical or diagnostic assessments, they are not administered or interpreted by a professional, and they are not a substitute for one. See section 6.
  • Astrology and divinatory features — horoscopes, tarot, transits, palm reading, compatibility reports, and games — are provided for entertainment and general informational purposes only.

Xivena does not predict your future and does not screen you for any condition.


6. Our approach to evidence

Our self-reflection features draw on models from published psychological research. You should be able to check that for yourself, so this section sets out what we rely on — and, just as importantly, what we do not claim.

The models our assessments draw on

  • Five-factor ("Big Five") personality structure — Donnellan, Oswald, Baird & Lucas (2006), Psychological Assessment (doi.org/10.1037/1040-3590.18.2.192); Soto & John (2017), Journal of Personality and Social Psychology (doi.org/10.1037/pspp0000096).
  • Morningness–eveningness (chronotype) — Horne & Östberg (1976), Morningness-Eveningness Questionnaire (doi.org/10.1037/t02254-000); Taillard, Philip, Chastang & Bioulac (2004), Journal of Biological Rhythms (doi.org/10.1177/0748730403259849).
  • Adult attachment — Bartholomew & Horowitz (1991), Journal of Personality and Social Psychology (doi.org/10.1037/0022-3514.61.2.226); Fraley, Waller & Brennan (2000), Journal of Personality and Social Psychology (doi.org/10.1037/0022-3514.78.2.350); Candel & Turliuc (2019), Personality and Individual Differences (doi.org/10.1016/j.paid.2019.04.037).
  • Character strengths — items drawn from the public-domain International Personality Item Pool (ipip.ori.org); Goldberg et al. (2006), Journal of Research in Personality (doi.org/10.1016/j.jrp.2005.08.007).

Where we refuse to guess

Research on couples consistently finds that similarity in personality traits explains almost none of how satisfied people actually are together — less than half of one percent of the variation, across more than 23,000 couples (Dyrenforth, Kashy, Donnellan & Lucas, 2010, doi.org/10.1037/a0020385). A machine-learning study across 43 longitudinal studies found that how a person feels about their specific relationship predicts far more than their individual traits do (Joel et al., 2020, doi.org/10.1073/pnas.1917036117). Attachment similarity showed no such effects across 1,602 couples (Weidmann, Yang, Purol & Chopik, 2024, doi.org/10.1177/02654075241298710).

So Your People does not give you a compatibility score, a percentage match, or a verdict on whether two people suit each other. Where the evidence does not support a number, we would rather say so than invent one.

The same principle applies to sleep. Our chronotype questionnaire asks two separate things: when you are at your sharpest, and how easily your sleep is broken. The research cited above supports the first — a daily rhythm is a real, measurable difference between people. It supports nothing about the second, and we do not pretend otherwise: when we describe your sleep as light or steady, we are repeating what you told us, not measuring it. The established instruments in this area are clinical tools for screening insomnia, and we have deliberately not used one. Xivena does not screen you for anything, and it does not tell you when to go to bed.

What we do not claim

  • Our questionnaires are our own. They are informed by the models above, but they are not those published instruments, and they have not been validated. A result from Xivena is not equivalent to one from a validated instrument administered by a professional, and should not be treated as one.
  • Some assessments are original to Xivena and are not adapted from any published instrument.
  • A cited model does not vouch for our version of it. That a body of research supports an idea does not establish that our questionnaire measures it correctly in you.
  • Not every feature rests on research at all. Horoscopes, tarot, transits, palm reading, and compatibility reports are not science-based and are offered for entertainment.
  • No result here is a diagnosis, a clinical assessment, or a measure of your health.

We cite sources so that you can read them yourself and judge. If you believe we have described a finding wrongly, tell us at babakulov@xivena.com and we will correct it.


7. Your Content and licence

You keep ownership of Your Content. To operate the Service, you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display Your Content for the purpose of providing the Service to you, including sending the relevant parts of it to the AI providers named in our Privacy Policy. This licence ends when you delete the Content or close your account, except for the records section 16 says we keep.

You are responsible for the accuracy of Your Content and for having the right to share it. Only enter another person's details — for Your People or a compatibility report — if you have their permission.

We may use aggregated and anonymised data, which does not identify you, to maintain and improve the Service.


8. AI Output

You may use the readings, reflections, and other AI Output you receive for your own personal, non-commercial purposes. Because AI Output is generated automatically, we make no warranty that it is original or free of third-party rights, and we do not grant you any copyright or ownership in it beyond your personal use.


9. Payments, subscriptions, and refunds

Xivena offers paid subscriptions (Premium and Celestial) and one-off purchases (such as Expert sessions and written reports). How you pay, and how a refund works, depends on where you buy.

  • On the website, payments are processed by Paddle, which acts as the Merchant of Record for your purchase and handles customer service and refunds for it.
  • In the iPhone app, payments are processed by Apple through In-App Purchase. Your purchases and any refunds are governed by Apple's terms and handled by Apple, not by Xivena. You manage or cancel iPhone subscriptions in your Apple account settings; the app's Settings screen opens that page for you.
  • In the Android app, payments are processed by Google Play. Your purchases and any refunds are governed by Google's terms and handled by Google.

Subscriptions renew automatically until cancelled. Cancelling stops the next renewal; the current period runs to its end. Prices may change; we will give you reasonable notice before any change affects you. Our Refund Policy forms part of these Terms and sets out the rules for each store, what happens to Tokens when a purchase is refunded, and your statutory rights.


10. Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, or abusive purpose
  • Enter another person's personal details without their permission
  • Attempt to access, scrape, or interfere with the Service or its security
  • Reverse-engineer or copy the Service
  • Use the Service or its Content to train or build competing AI models
  • Create multiple accounts, or delete and recreate an account, to obtain a further free allowance or to circumvent usage limits

We may suspend or close an account that breaches this section.


11. Privacy

Our Privacy Policy explains what data we collect, how we use and protect it, which providers receive it, and what we keep after you delete your account. By creating an account you confirm that it was made available to you. Where a specific activity requires your consent — sharing your data with AI providers is one — we ask for that choice separately inside the app, and you can withdraw it at any time.


12. Third-party services

The Service relies on third-party providers for hosting, AI, voice and video, sign-in, email, and payments. They are listed in our Privacy Policy. Your use of those features may also be subject to the providers' own terms. We are responsible for our own obligations, but not for the independent acts of third-party providers beyond what our contracts with them provide.


13. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any Content will be accurate. Nothing in these Terms excludes any right you have under mandatory consumer-protection law.


14. Limitation of liability

To the maximum extent permitted by law, Xivena will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability arising out of or relating to your use of the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) GBP 100.

Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you are a consumer in a jurisdiction with mandatory liability rules, those rules apply despite this section.


15. Indemnification

You agree to indemnify and hold Xivena harmless from any claim, liability, or cost (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your entering another person's data without permission.


16. Suspension, termination, and what remains

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that harms other users, us, or third parties. Otherwise we give reasonable notice.

You may delete your account at any time from Settings. Deleting your account permanently removes your profile, Your Content, your readings, and your sign-in from our systems. Three things remain, as our Privacy Policy explains: records of your purchases (kept for tax and accounting law), an append-only log of administrative actions that references your account identifier and the action taken, and the one-way marker described in section 4.3 that tells us the free allowance has already been used. Nothing else survives.

Sections that by their nature should survive — the Content licence for the records we keep, the disclaimers, the limitation of liability, indemnification, and governing law — survive termination.


17. Changes to these Terms

We may update these Terms. Each version carries a version number and an effective date at the top of this page. When we make a material change, we will email the address on your account before the change takes effect, telling you what changed and where to read it. You may close your account before that date if you do not wish to continue under the updated Terms. Continued use after the effective date means you accept the updated Terms.


18. Governing law and dispute resolution

These Terms are governed by the laws of England and Wales. The courts of London, England have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory law in your country of residence gives you the right to bring proceedings elsewhere. Before starting a court action, please write to us at babakulov@xivena.com so that we can try to resolve the matter informally.


19. Miscellaneous

  • Severability. If any part of these Terms is found unenforceable, the rest remains in force.
  • Assignment. You may not transfer your rights under these Terms; we may transfer ours as part of a business transfer.
  • No waiver. If we do not enforce a right, that is not a waiver of it.
  • Entire agreement. These Terms, the Privacy Policy, and the Refund Policy are the entire agreement between you and us about the Service.
  • Language. These Terms are written in English. We publish translations for convenience; if a translation and the English text conflict, the English text prevails, except where mandatory local law requires otherwise.
