Welcome to Xivena. These Terms of Use (“Terms”) govern your access to and use of the Xivena website at xivena.com and our mobile applications (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

• “We,” “us,” “our,” “Xivena” means Babakulov Shakhzodbek, an individual sole trader, who operates the Service.
• “You” means the person who uses the Service.
• “Content” means anything generated, displayed, or made available through the Service, including AI-generated readings.
• “Your Content” means the information you provide, such as your birth data, dream journal entries, and palm photographs.

You must be at least 18 years old to use the Service. By using Xivena, you confirm that you are 18 or over and able to enter into a binding agreement with us.

You sign in with Google, Apple, or email. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that takes place under your account. Please tell us promptly if you believe your account has been compromised.

Xivena offers AI-assisted astrology and self-reflection features, which may include:

• Horoscopes and zodiac insights
• Tarot readings
• Live transits
• Palm reading
• A dream journal and dream interpretation
• Compatibility reports
• Conversations with AI experts by chat, voice, and video
• Interactive games

We may add, change, or remove features at any time to improve the Service.

Xivena uses artificial intelligence to generate horoscopes, tarot, dream interpretations, palm analysis, and other readings. This content is created automatically and may be inaccurate, incomplete, or inconsistent.

You keep ownership of Your Content. To operate the Service, you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display Your Content for the purpose of providing the Service to you. We may also use aggregated and anonymised data — which does not identify you — to maintain and improve the Service.

You may use the readings and other AI-generated Content you receive for your own personal, non-commercial purposes. Because AI output is generated automatically, we make no warranty that it is original or free of third-party rights, and we do not grant you any copyright or ownership in it beyond your personal use.

Xivena offers paid subscriptions (such as Premium and Celestial) and one-off purchases (such as reports and expert sessions). How you pay and how refunds work depends on where you buy:

• On the web, payments are processed by Paddle, which acts as the Merchant of Record for your purchase. You can cancel a subscription at any time, and it will not renew after the current billing period. Refunds are handled by Paddle in accordance with their buyer terms and applicable consumer-protection law.
• On iOS, payments are processed by Apple through In-App Purchase. Your purchases and any refunds on iOS are governed by Apple’s terms, and refunds are handled by Apple, not by Xivena. You can manage or cancel iOS subscriptions in your Apple account settings.

Subscriptions renew automatically until cancelled. Prices may change; we will give you reasonable notice before any change affects you.

When using the Service, you agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose
• Upload another person’s personal data without their permission
• Attempt to access, scrape, or interfere with the Service or its security
• Reverse-engineer or copy the Service
• Use the Service or its Content to train or build competing AI models
• Create multiple accounts to circumvent usage limits

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect and how we use and protect it. Please read it carefully.

The Service relies on third-party providers for hosting, AI, voice and video, authentication, and payments. Your use of those features may also be subject to the providers’ own terms. We are not responsible for the acts or omissions of third-party providers beyond our control.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any Content will be accurate. Nothing in these Terms excludes any rights you have under mandatory consumer-protection law.

To the maximum extent permitted by law, Xivena will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

14. Indemnification

You agree to indemnify and hold harmless Xivena from any claims, damages, or expenses arising from your misuse of the Service, your breach of these Terms, or your uploading of another person’s data without permission.

15. Suspension & Termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that harms other users, us, or third parties. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ends immediately.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. If the changes are significant, we will take reasonable steps to let you know. Continued use of the Service after the changes take effect means you accept the revised Terms.

These Terms are governed by the laws of England and Wales. The courts of London, England have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory law in your country of residence gives you the right to bring proceedings elsewhere.

18. Miscellaneous

• Severability: if any part of these Terms is found unenforceable, the rest remains in force.
• Assignment: you may not transfer your rights under these Terms; we may transfer ours as part of a business transfer.
• No waiver: if we do not enforce a right, that is not a waiver of it.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Service.
• Language: these Terms are written in English, which is the governing language.
